Your West Virginia Personal Injury Case and Social Media

One of the preliminary questions asked to clients when they come to our office is if they use any type of social media.  Sites like Facebook and Twitter are very popular among people of all ages to connect with friends and family.  However, when an individual is involved in a personal injury case, social media habits and usage should change.

In some instances, even when privacy settings are increased, insurance companies are allowed to monitor an individual's social media activity.  Any status update or picture can be misconstrued by an insurance company and could hurt your case. 

Because of this, we often suggest that our clients stop using their social media account while they have an active personal injury claim and/or case.  Sometimes, however, this is not easily done or possible.  In the event that you do have a social media account that you are unable to deactivate during a personal injury claim, here are some things to consider to help lessen the chance of social media harming your case:

  • Don't post any status updates complaining about any aspect of your case- nothing about your injury, insurance company, case, or process of your case;
  • Dont give any information about your case or its proceedings;
  • Remind your family and friends not to tag you in any videos, photographs, or posts on social media.  If an insurance company investigator can't access your information, they may be able to find information out about you through another individual's site.
  • Make sure your privacy settings on your account are viewable only to friends.
  • Do not accept friend requests from anyone you do not know.  A person requesting to be your friend whom you do not know could easily be an investigator seeking information about you, your case, and/or your injuries.

It is extremely important to keep your personal information private, especially when making a personal injury claim.  While it may seem like a burden to deactivate or limit your social media usage while you have an active case, it will be much more beneficial in the long run.  Our attorneys have the expertise to guide you through this process.  Their advice may be cumbersome, but will help you to get the compensation you deserve.
