Former collegiate athlete sues over poor concussion management

A former football player from Portland State University has filed a lawsuit against the school as well as the NCAA for damages related to a sustained concussion. The athlete alleges that the defendants failed to provide adequate post-concussion medical care and negligently allowed him to resume participating in football related activities.

According to various reports, the athlete suffered a concussion in his first season playing for the Portland State University Vikings. The athlete claims that he was cleared to resume play before his concussion had been completely resolved and that he never received sufficient post-concussion testing and care.

According to the attorney for the athlete, procedures were in place to handle return to play issues but they were completely ignored. According to the suit, the athlete was given the Immediate Post Concussion Assessment and Cognitive Testing (also known as ImPACT Test). The athlete failed the first ImPACT test which is designed to assist in the assessment of whether a player has returned to baseline and has recovered from a concussion. The athlete alleges that a second ImPACT test was necessary prior to giving him the green light to resume play but that said test was never performed.

A concussion is a form of mild traumatic brain injury that occurs when the head hits an object or a moving object strikes the head. Concussions can affect how the brain operates and can lead to bad headaches, changes in alertness, or loss of consciousness.

This lawsuit is the recent in a string of sports-related lawsuits concerning concussions.
