On September 8, 2014, a 12 person jury in Texas ordered Boston Scientific Corporation to pay a Texas woman $73 Million after finding the company negligent in designing and marketing its Obtryx transvaginal mesh sling.
The case was the first of many to go to trial against Boston Scientific in Texas State Court and was also the first verdict against the company for negligent design and marketing of the company’s product. The award by the jury including a $50 million dollar punitive damage award-far larger than other punitive awards in other mesh cases.
After nine days of testimony, the jury determined that Boston Scientific’s Obtryx transvaginal sling caused the Plaintiff permanent pain, a limp, and the burden of 42 additional medical procedures including four major surgeries. The Plaintiff presented testimony that she can no longer sit comfortably, walk, or exercise without constant pain as a result of the injuries caused by the mesh.
Boston Scientific faces an additional 12,000 lawsuits in which women across the country claim the company’s transvaginal slings are defective and caused tissue and organ damage resulting in surgeries and permanent pain and suffering.
